These terms and conditions set out the rules and regulations for the use of Briavel Institute’s website, located at www.briavelinstitute.com. By accessing this website, we assume you accept these terms and conditions. Do not continue to use Briavel Institute if you do not agree to all of the terms and conditions on this page.
1. Definitions
- The Institute – Briavel Institute.
- The Student – anyone enrolled or registered for courses at Briavel Institute.
- Course Materials – the information provided by Briavel Institute to accompany a course, in hard copy or electronic form.
- Fees – the fees you pay to Briavel Institute for the Services.
- Services – the online classes, recorded videos and Course Materials, together with any other services agreed and purchased by you.
- Online course – an online course through which you learn course materials remotely.
- Live class – a course taught by us which you attend remotely.
- Website – www.briavelinstitute.com.
- You – the individual purchasing the Services.
“Client”, “You” and “Your” refer to you, the person logging on to this website and complying with the Institute’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us” refer to the Institute. “Party” or “Parties” refers to both you and us.
Important information
Please read these conditions carefully, as they form part of the contract between the Student (if an adult) and Briavel Institute. Make sure you have read and understood all of them and confirm that you accept them when you enroll.
By enrolling in a course and paying the fees, you acknowledge that you have read and understood the terms relating to admission (also available on this website) and agree to be bound by them. Any deficiency in the admission process cannot be used as an excuse for not abiding by the terms relating to admission, payment of fees, refunds or use of the student’s name by the Institute.
2. Services
We provide the Services with reasonable care and skill, in line with the details given on the website. We reserve the right to change or withdraw any of the Services described on the website without notice.
You should confirm that the Services you are purchasing meet your needs. We do not guarantee that you will obtain a particular result, professional qualification or employment opportunity from purchasing and completing any of the Services.
2.1 Use of the site
You agree to use the site only for lawful purposes, and in a way that does not infringe the rights of, or restrict or inhibit anyone else’s use and enjoyment of, the website. Prohibited behaviour includes harassing or causing distress or inconvenience to other users, transmitting obscene or offensive content, and disrupting the normal flow of dialogue on the website.
3. Ordering the Services
By purchasing Services through the website, or by transferring the fees to the account given on the website, you offer to purchase the Services on these terms. Briavel Institute may cancel or decline your order, or any part of it, until it has been confirmed by us: (a) accepting your offer by sending you an email confirming the purchase; and (b) receiving payment of the relevant Fees in accordance with clause 4.
The receipt and confirmation of your purchase will be sent to you by email. All orders are processed within 7 business days, and are not delivered on weekends or holidays.
Briavel Institute is not responsible for customs duties or taxes applied to your order; any fees imposed during or after delivery (tariffs, taxes and so on) are the student’s responsibility. Briavel Institute is not responsible for booking any examination with a professional body or examination board. It is your responsibility to book your exam before the relevant closing date.
4. Fees
Course fees include tuition and all relevant course materials. The Fees are as set out on the website, or as told to you by telephone or email when you placed your order. Fees are paid as a lump sum and are exclusive of GST or other local taxes. To pay online, visit www.briavelinstitute.com.
Early-bird discounts (15% off the course fee) and group discounts may be available. Discounts cannot be combined with any other offer, and places are subject to availability. You are responsible for any costs you incur in attending an online course.
5. Liability
Briavel Institute aims to provide Services of the highest standard. However, neither we nor our trainers accept liability for (i) any inaccurate or misleading information in the programmes or Course Materials, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect loss arising from a breach of this agreement.
Our total liability arising from these terms and the delivery of the Services (whether for breach of contract, negligence or any other reason) is limited to the Fees we received for the online course in dispute. No claim may be brought more than one month after the last date on which the Services concerned were provided.
6. Cancellation
Once we have confirmed the Services you purchased, you may cancel within 15 days of the purchase date, except for online courses. If you have purchased an online course and have already accessed, downloaded or started to use any part of it, you have no right to cancel your order.
7. Refund policy
Our refund policy ensures all refunds are processed fairly. If you ask to cancel an online class, we will consider a refund. Refunds are paid only by online transfer, only into a savings account in the student’s name, within a reasonable time of receiving the application to withdraw.
The Institute is not responsible for refunds credited to the wrong account because of incorrect details supplied by the student.
8. Intellectual property
All intellectual property rights in the Course Materials, online courses and the trainers’ talks in live classes are and remain the property of Briavel Institute.
8.1 You are not authorised to: (i) copy, modify, reproduce, republish, sub-license, sell, upload, broadcast, post, transmit or distribute any Course Materials without our prior written permission; (ii) record on video or audio, or relay by any means, an online course or live class; (iii) remove any copyright or other notice of Briavel Institute from the Course Materials; (iv) modify, adapt, merge, translate, disassemble, decompile or reverse-engineer (except as permitted by law) any software forming part of the online courses. A breach of clause 8.1 allows us to terminate these terms immediately and stop providing you with any Services, including access to online courses.
8.2 In return for the Fees, we grant you a limited, non-transferable, non-exclusive licence to use the Course Materials and online course software solely to complete the online course and/or attend the live class.
9. Confidentiality
Each party will keep the other party’s confidential information strictly confidential, use it only for the purposes of these terms, return it on demand and not keep copies. Either party may disclose confidential information to its legal and other advisers to obtain advice. This clause continues after these terms end.
10. Privacy
Please review our Privacy Policy, which also governs your visit to Briavel Institute. Personal information you provide will be treated as strictly confidential and in line with the Privacy Policy and applicable laws.
11. Termination
We may terminate these terms and stop providing Services with immediate effect if you:
- fail to pay your Fees when due;
- act in an aggressive, offensive, threatening or harassing manner towards any Briavel Institute employee, teacher or lecturer, or any student attending a live class;
- are, in the teachers’ view, not working, creating indiscipline, irregular, unresponsive, or posting or spreading false or negative messages on social media or messaging platforms. The student may then be expelled; the Institute’s decision is final and binding, and no fees will be refunded;
- breach these terms and conditions.
Clauses 5 (liability), 8 (intellectual property) and 9 (confidentiality) continue after termination.
12. Assignment
Services provided under these terms are personal to you and cannot be transferred to anyone else. We may assign these terms to another company without notice to you.
13. Agreement
These terms, together with the Website Disclaimer and any course-specific terms, are the entire agreement between the parties and replace any prior agreements, written or oral. You confirm that you have not relied on any representations in entering into these terms. Nothing in this clause limits liability for fraudulent misrepresentation.
14. Force majeure
Briavel Institute is not liable for any breach of its obligations, or termination, arising from causes beyond its reasonable control, including fire, flood, earthquake and other natural events, terrorism, strikes, transport disputes, a death in the trainer’s family, illness of the trainer, or government edict or regulation.
15. Publicity
The Institute may use individual or group photographs and the name of any student who secures a position or rank, or succeeds in any professional exam, in all kinds of media at any time. The Institute may also record video or audio testimonials from students, during or after the course, for reference or promotion. No separate permission will be sought.
16. Comments, feedback and other submissions
If you send us submissions, creative ideas, suggestions, proposals, plans or other materials (online, by email, by post or otherwise), whether or not we asked for them, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium, at any time and without restriction.
17. Errors, inaccuracies and omissions
Information on our site or in the Services may occasionally contain typographical errors, inaccuracies or omissions relating to service descriptions, pricing, promotions, offers, charges, transit times and availability.
18. Prohibited uses
You may not use the site or its content for any unlawful purpose; to solicit others to perform or take part in unlawful acts; to violate any international, national or local regulations, rules or laws; or to infringe our intellectual property rights or those of others.
19. Law and jurisdiction
This agreement is governed by Indian law, and the parties submit to the exclusive jurisdiction of the Indian courts, specifically the District Court, Thrissur, for any dispute.
20. Disclaimer
